AthenaCX Platform End User License Agreement

The AthenaCX application is protected by copyright and may not be reproduced or used without the expressed written permission of Dublin City University (DCU). Individuals or persons using AthenaCX (Users) may use the AthenaCX application on all Android, iOS, handheld smartphones, tablets and web-based computing devices only for personal use. Researchers using the AthenaCX platform for commercial and academic use must ensure Users taking part in studies are fully aware of the reasons for why the research is being carried out and how their data contributions will be used. The software in its entirety is protected by copyright laws. The software also contains trade secrets and Users may not decompile, reverse engineer, disassemble, or otherwise reduce the software to human-perceivable form or disable any functionality which limits the use of the software. The User may not modify, adapt, translate, rent or sublicense (including offering the software to third parties on an application service provider or time share basis), assign, loan, resell for profit, or distribute the software, discs or related materials or create derivative works based upon the software or any part thereof, without the express written permission of relevant members of DCU.

Users may have been referred to the AthenaCX app by a research company or a third party, such as an academic researcher.

The AthenaCX Application Disclaimer

The AthenaCX application is designed to help User contribute towards research which will generally be carried out by other parties. In this regard, the AthenaCX application has no control over, and makes no representations or warranties, express or implied, regarding User’s or User’s co-operation with researchers or third party(s) use of the AthenaCX application or the use or interpretation of any information stored on, generated by or received through the AthenaCX application. User is solely responsible for communicating any health-related information to (and receiving feedback from) User’s healthcare provider(s). The AthenaCX application does not provide its licensors access to data that can identify the User. Authorized individuals are usually limited to the User’s designated healthcare provider who has referred the User.

User is solely responsible for reviewing and evaluating the accuracy and relevance of any information stored on, generated by or received through the AthenaCX application. DCU cannot and does not guarantee said accuracy.

The AthenaCX APPLICATION AND ANY INFORMATION STORED ON, GENERATED BY OR RECEIVED THROUGH THE AthenaCX APPLICATION, INCLUDING PERSONALIZED EDUCATION BASED ON DATA-MINING OF DATA, ARE NOT INTENDED TO BE A SUBSTITUTE FOR PROFESSIONAL MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT. ALWAYS SEEK THE ADVICE OF A PHYSICIAN OR OTHER QUALIFIED HEALTHCARE PROVIDER WITH ANY QUESTIONS REGARDING A MEDICAL CONDITION. NEVER DISREGARD PROFESSIONAL MEDICAL ADVICE OR DELAY IN SEEKING IT BECAUSE OF SOMETHING READ OR LEARNED THROUGH THE USE OF THE AthenaCX APPLICATION OR ANY INFORMATION STORED ON, GENERATED BY OR RECEIVED THROUGH THE AthenaCX APPLICATION.

User acknowledges that DCU or its licensors, in their sole discretion, may from time to time make modifications to the AthenCX application. Such modifications may require corresponding changes to be made in the User’s systems. Changes or failure to make timely changes by User may sever or effect User’s access to the AthenaCX application. Neither DCU nor its licensors shall be responsible for such effects, and neither DCU nor its licensors shall have any obligation to furnish any maintenance and support services with respect to the AthenaCX application.

The AthenaCX application is intended for research purposes only.
